1. Vehicle speed is continuously monitored by the ELD device scanning the engine’s ECM for speed data to determine whether the vehicle is moving
2. Once the device has received at least 4 readings within 45 seconds after the 1st reading over 5 mph, the driver’s status will automatically change to Driving
3. Driver’s status will remain in Driving until:
➢ Driver manually indicates a different duty status, or
➢ After 5 consecutive minutes recorded at 0 mph, the ELD will prompt the driver to confirm whether they are still driving. If the driver doesn’t respond to this prompt within 1 minute (so now a total of 6 minutes after the vehicle stopped), the ELD will automatically change the status to On Duty Not Driving
1. If Personal Use (PU) is enabled, the driver’s status will remain OFF DUTY while vehicle is moving
2. If Yard Moves (YM) is enabled, the driver’s status will remain ON DUTY NOT DRIVING while vehicle is moving
3. NOTE: As soon as the ignition goes through a power off/on cycle, the driver will receive a prompt as to whether they wish to continue using the PU or YM. If they select “No” on the prompt or fail to respond before the vehicle moves again, then the driver’s status will be changed to Driving as normal
1. Assignment of Unidentified Driver records. ELD events recorded under the “Unidentified Driver” profile may be edited and assigned to the driver associated with the record; and
2. Team Drivers may reassign mistake driving time to the correct driver on the team

An ELD must automatically determine whether a CMV is in motion or stopped by comparing the vehicle speed information with respect to a set speed threshold as follows:
(1) Once the vehicle speed exceeds the set speed threshold, it must be considered in motion.
(2) Once in motion, the vehicle must be considered in motion until its speed falls to 0 miles per hour and stays at 0 miles per hour for 3 consecutive seconds. Then, the vehicle will be considered stopped.
(3) An ELD's set speed threshold for determination of the in-motion state for the purpose of this section must not be configurable to greater than 5 miles per hour.
